Md. appeals court upholds $7M anti-adultery provision in postnup

A recent ruling from Maryland's Court of Special Appeals has upheld a remarkable provision in a postnuptial agreement, affirming a substantial $7 million compensation for adultery. The case revolves around a former couple from Chevy Chase, where the husband, Thomas Lloyd, breached the terms of the postnup by engaging in extramarital affairs.

Anna Niceta, Lloyd's ex-wife, initiated the postnuptial agreement after forgiving him for a previous affair in 2014. The agreement, reached in 2015, stipulated a lump sum payment of $7 million if Lloyd were to engage in any romantic or sexual activities outside of their marriage, including kissing, hugging, fondling, emailing, or sexting.

Despite Lloyd's objections, the Court of Special Appeals upheld the agreement's validity, emphasizing that Lloyd had willingly entered into the agreement with full legal representation and understanding of its terms. The court also reasoned that Niceta's decision to forgo immediate divorce proceedings and work on reconciling the marriage constituted valid consideration for the agreement.

Furthermore, the court dismissed Lloyd's argument that the $7 million penalty was excessive, citing his anticipated $12 million inheritance from his ailing father as a mitigating factor. Additionally, the court rejected Lloyd's contention that enforcing such a provision would foster marital discord, noting that explicit terms could provide clarity and stability within the relationship.

This ruling has drawn attention to the enforceability of anti-adultery clauses in postnuptial agreements and provides valuable guidance for legal practitioners navigating similar cases. The decision underscores the significance of mutual consideration in marital contracts and highlights the role of courts in upholding agreements reached between spouses, even in sensitive matters such as adultery.
